Hygienically clean water in the swimming pool is the basic prerequisite for relaxing hours in the pool. Decades of experience and thousands of installed pool systems enable BWT water treatment to fulfil the highest requirements in terms of safety, hygiene and health.
1. obligations of the pool operator
Granting use of the facilities, assumption of risk by guests
- The hotel allows guests to use the facilities of the bathing complex at their own risk within the framework of the provisions of these bathing regulations.
- It is not possible for either the hotel or the staff to prevent bathing accidents in general. In particular, the guests themselves bear the risks associated with practising the sport practised on the bathing area.
- The same applies to injuries and other intrusions into the personal sphere of the guest by other guests or other third parties who are not members of the pool staff.
- The hotel only assumes the following obligations towards guests.
Opening hours and granting of access
- The pool operator is obliged to allow visitors to enter during the opening hours announced on the notice board or by the staff.
- If the officially authorised number of visitors is exceeded, the hotel may, with the assistance of the staff responsible, prohibit the admission of further visitors. In such cases, visitors must expect waiting times.
- The hotel reserves the right to deny access to persons who are not authorised to visit the pool without giving reasons.
Condition and operation of the facilities
- The pool operator is responsible for ensuring that the facilities are installed, operated and maintained in accordance with regulations. In particular, the pool operator must comply with all applicable hygiene and safety regulations. The pool operator has no further obligations.
- As soon as the pool operator becomes aware of the malfunction, defectiveness or damage of a facility that no longer guarantees safe operation, the pool operator shall immediately prohibit the use of the malfunctioning facility or restrict its use in an appropriate manner.
- The bathing guest is responsible for complying with the instructions of the responsible staff.
Monitoring compliance with the bathing regulations
The pool operator shall monitor compliance with the pool rules by guests and other persons on the premises of the facility within reasonable limits with the help of the responsible staff. If irregular behaviour is detected, the persons concerned will be warned and may be expelled from the premises if necessary.
Assistance in the event of accidents
In the event of an accident, the pool operator will immediately initiate assistance measures with the help of the responsible staff within reasonable limits.
Assistance in the defence against reported dangers
If the pool operator, in particular the responsible staff, is notified by guests of an imminent danger to the health and life of guests, the pool operator shall endeavour to avert this danger within reasonable limits with the help of the staff.
No possibility of supervising minors, underage persons, disabled persons and non-swimmers
The pool operator and therefore the staff are not able and therefore not obliged to supervise minors, persons under the age of majority or physically or mentally disabled persons and non-swimmers.
Liability of the pool operator
- The pool operator is only liable for damage caused to the guest by unlawful behaviour, in particular behaviour in breach of contract and culpable behaviour.
- The pool operator shall not be liable for damage caused by disregarding the pool rules, any other rules of use or by disregarding the instructions of the staff, by any other fault of the injured party or by unavoidable events or force majeure, in particular also by interference by third parties. Contributory negligence leads to a corresponding apportionment of damages. The same applies mutatis mutandis to conspicuous special rules of use displayed at the respective equipment and facilities (e.g. for the slide, diving tower, sauna, etc.) as well as to conspicuous bans on use or restrictions within the meaning of point 1.3. para. 2.
- The use of car parks is at your own risk. The pool operator is not obliged to guard car parks or to maintain their areas and other facilities in order to protect vehicles from damage (e.g. from nails, broken glass or potholes on the areas).

- The applicable youth protection regulations, in particular bans on alcohol and smoking, bans on staying on the premises, obligations of legal guardians, must be observed by the young people and their legal guardians.
Supervision of group visits
- In the case of group visits, the responsible supervisor must ensure compliance with the pool rules in the case of schoolchildren and the responsible official in the case of clubs and other organisations, and must bear full responsibility for this. The relevant supervisors must be present for the entire duration of the group visit.
- These supervisors must liaise with the pool operator's supervisory staff in order to ensure that other normal pool operations are not disrupted by the group visit.
